1. Acceptance of Terms

By downloading, installing, or using Kurato ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and rawplusdry.com ("we," "us," or "our").

2. Description of Service

Kurato is an AI-powered application that allows users to:

Save and organize web links into projects
Extract structured data from web pages using Google Gemini AI
Share projects and collaborate with other users
Comment on and discuss saved links
Search and filter collected data

The App uses cloud-based services including Firebase (for storage and authentication) and Google Gemini API (for AI-powered data extraction).

3. User Accounts and Registration

3.1 Account Creation

To use Kurato, you must create an account using one of the following methods:

Sign in with Google
Sign in with Apple
Anonymous sign-in (limited features)

3.2 Account Responsibilities

You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use of your account

3.3 Accurate Information

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

4. Acceptable Use Policy

You agree NOT to use the App to:

Violate any applicable laws or regulations
Infringe upon the intellectual property rights of others
Post, share, or transmit illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable content
Harass, abuse, or harm other users
Impersonate any person or entity
Distribute spam, malware, or viruses
Attempt to gain unauthorized access to the App or its related systems
Interfere with or disrupt the App's servers or networks
Collect or store personal information about other users without their consent
Use the App for any commercial purpose without our prior written consent

5. User-Generated Content

5.1 Content Ownership

You retain ownership of all content you submit, post, or share through the App, including:

Web links and URLs
Project names and descriptions
Comments and discussions
Manually entered data

5.2 Content License

By submitting content to the App, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and transmit your content solely for the purpose of providing and improving the App's services.

5.3 Content Guidelines

All user-generated content must comply with our Acceptable Use Policy. We reserve the right to remove any content that violates these Terms or is otherwise objectionable.

5.4 Content Moderation

We reserve the right to review, monitor, and remove user-generated content at our discretion. Users can report inappropriate content through the in-app reporting feature.

6. AI Processing and Data Usage

            Important: Kurato uses Google Gemini AI to analyze web page content and extract structured data.
        

6.1 AI Consent Required

Before using AI extraction features, you must provide explicit consent to have your data processed by Google Gemini AI. This consent is required by Apple App Store Guidelines.

6.2 Data Sent to AI

When you add a link to a project (not Inbox), the following data is sent to Google's servers:

Web page content (HTML)
Your project name and purpose
The URL you're analyzing

6.3 AI Data Processing

Data sent to Google Gemini AI is subject to Google's Privacy Policy. We do not control how Google processes this data.

6.4 Opting Out

You can opt out of AI processing by:

Saving links to your Inbox instead of projects
Not providing AI consent when prompted
Deleting your account to remove all data

7. Intellectual Property Rights

7.1 Our Rights

The App, including its design, features, functionality, and all content not provided by users, is owned by us and is protected by copyright, trademark, and other intellectual property laws.

7.2 Trademarks

"Kurato" and associated logos are trademarks of rawplusdry.com. You may not use these trademarks without our prior written consent.

7.3 Web Content

You are responsible for ensuring you have the right to save, extract, and process content from websites you add to the App. We are not responsible for any copyright or intellectual property violations resulting from your use of the App.

7.4 Robots.txt and Web Scraping Compliance

When using Kurato's web scraping features, you agree to:

Respect robots.txt files and meta tags that restrict automated access
Comply with websites' terms of service and acceptable use policies
Avoid excessive requests that could overload or disrupt website servers
Not scrape content from websites that explicitly prohibit automated access

Kurato makes reasonable efforts to respect robots.txt directives where technically feasible, but you remain ultimately responsible for ensuring your use complies with applicable laws and website policies. Misuse of web scraping features may result in account suspension or termination.

8. Subscription and Payment Terms

8.1 Free and Pro Tiers

Kurato offers two service tiers:

Free: Limited to 10 AI extractions per month
Pro: Up to 500 AI extractions per day (paid subscription)

8.2 Fair Use Policy for Pro Subscriptions

Pro subscriptions include "up to 500 AI extractions per day" subject to fair use.

Fair use means:

Extractions are for personal, legitimate use only
Not for automated scraping, bulk processing, or commercial data harvesting
Not for reselling extracted data or providing extraction services to third parties
Not for creating competing AI extraction services

Abuse Prevention:

We monitor usage patterns for abuse (e.g., excessive automated requests, rapid-fire extractions)
Users who violate fair use may have their subscription cancelled without refund
In severe cases, accounts may be permanently banned and deleted
If we detect abuse, we will contact you first before taking action (except in extreme cases)

The 500/day limit is designed for heavy legitimate personal use, not unlimited commercial exploitation. Use the service responsibly.

8.3 Payment Processing

Subscriptions are processed through Apple's In-App Purchase system and are subject to Apple's terms and conditions.

8.4 Subscription Cancellation

You can cancel your subscription at any time through your Apple ID settings. Cancellations take effect at the end of the current billing period.

8.5 No Refunds

All subscription fees are non-refundable except as required by applicable law or at our sole discretion.

8.6 Price Changes

We reserve the right to change subscription prices with 30 days' notice to existing subscribers.

9. Termination

9.1 Termination by You

You may terminate your account at any time through the in-app account deletion feature. Upon deletion:

Your account and all associated data will be permanently deleted
You will lose access to all projects and saved links
This action cannot be undone

9.2 Termination by Us

We reserve the right to suspend or terminate your account immediately, without notice, if you:

Violate these Terms of Service
Engage in fraudulent or illegal activity
Abuse or harass other users
Use the App in a manner that could damage or impair our services

9.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

10. Disclaimers and Limitations of Liability

10.1 "AS IS" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 Service Availability

We do not guarantee that:

The App will be available at all times or without interruption
The App will be error-free or secure
AI extraction results will be accurate or complete
Any defects will be corrected

10.3 AI Accuracy Disclaimer

AI-generated data extractions may contain errors, inaccuracies, or omissions. You are solely responsible for verifying the accuracy of extracted data before relying on it.

10.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your use or inability to use the App
Any unauthorized access to or use of our servers or your data
Any bugs, viruses, or other harmful code
Any errors or omissions in any content
Any conduct of third parties using the App

10.5 Maximum Liability

Our total liability to you for all claims arising from or related to the App shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is greater.

11. Privacy

Your use of the App is also governed by our Privacy Policy, available at https://www.rawplusdry.com/kurato/privacy.html.

By using the App, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

Updating the "Last Updated" date at the top of this document
Providing in-app notification of significant changes
Requiring acceptance of new terms before continued use (for material changes)

Your continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in California, and you consent to personal jurisdiction in such courts.

13.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through good faith negotiation. If negotiation fails, disputes may be resolved through binding arbitration or small claims court.

14. Miscellaneous

14.1 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

14.2 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.3 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

16. Apple-Specific Terms

This App is available through the Apple App Store. In addition to these Terms, your use of the App is subject to Apple's Licensed Application End User License Agreement (EULA).

In the event of any conflict between these Terms and Apple's EULA, Apple's EULA shall prevail.
